The theme was created to delineate UGBs and document amendments to these boundaries since their original designations. As of September 2008 DLCD has taken over maintaining the data so a process was established obtaining data on the UGB Coverage layer for the state. To obtain as much precise data as possible to digitize the boundary layer for accuracy statewide, every city/metro UGB was assessed and updated based on DLCD, county and city records.
Under the Oregon Geographic Information Council, the Framework Implementation Team has delegated the development of an Administrative Boundaries Implementation Plan and an Administrative Boundary Data Content Standard. The Administrative Boundaries Framework is a collection of prioritized, spatially referenced digital representation of broadly defined feature sets for Oregon; of which one was identified as UGBs with a Very High priority and DLCD tasked as being the steward of the data.
This feature set will be detailed in the Oregon Framework database posted on the website maintained by the Geospatial Enterprise Office and updated annually.</idPurp>
<idCredit>This dataset was originally created in 2004 at the Oregon Department of Employment under a grant from the Oregon Geographic Information Council (OGIC). In 2006, DLCD partnered with the University of Oregon's Infographics Lab and ODOT for another comprehensive update to the data following as closely as possible the methodology followed in the 2004 project.
In 2008 DLCD took stewardship of the data and began a refined methodology necessary to bring the UGB data in line with other statewide framework elements through the OGIC data standards process. UGBs were optimized with reliance on cadastral tax lot data acquired through the Oregon Department of Revenue ORMAP project.
Every jurisdiction's entire UGB was reviewed against County records, City records and DLCD records. Discrepancies were verified against acknowledged plan amendments and/or City Ordinances.</idCredit>

<useLimit>JACKSON COUNTY GEOGRAPHIC INFORMATION SYSTEM DATA LICENSE THIS AGREEMENT is made by and between Jackson County called 'Licensor' and the user, hereinafter called 'Licensee.' The Licensor is the owner of multi-purpose GIS data and Jackson County specific data and the authorized repository of other GIS data that is not owned by the Licensor. This Agreement shall not transfer the ownership of any GIS data, which shall be retained by its current owner. The Licensee wishes to secure the non-exclusive right to use the Jackson County GIS (JCGIS) data.
IN CONSIDERATION of the mutual covenants and conditions herein contained, the Licensor and Licensee agree as follows: 1) TERMS OF USE: a) Rights Granted: i) The Licensor grants to the Licensee the non-exclusive and non-transferable right to use the licensed products and data (hereinafter the 'licensed data'); ii) Licensee assumes responsibility to determine the appropriate use of the licensed data; iii) Data Delivery - The licensed data shall normally be furnished as a no-cost, online download delivered on the JCGIS website. If other means of delivery or storage shall be used, all such data, tapes, disks, manuals, and printed materials will be furnished by the Licensor for a fee. The terms and provisions of this agreement shall nevertheless apply thereto. b) Permissions: i) The licensed data are for use by the Licensee only, and are not intended to be republished or sold; ii) The Licensee may copy licensed data only for backup purposes and not for use by any other person; iii) Licensed data may be used only on computer equipment owned or leased by the Licensee; iv) Graphic displays and printed tabular listings derived from licensed data may be used in publications and presentations unless otherwise noted in Metadata. c) Limitations: i) The licensed data remains the sole intellectual property of its respective owner(s) and is used herein with permission; ii) Any available metadata (documentation file) is an integral part of the licensed data and shall be used with and accompany the licensed data. Users shall read it and abide by its terms and conditions; iii) Any sale, reproduction, distribution, loan, or offering for use of licensed data by the Licensee, in whole or in part, is prohibited. d) Authorized Users – The licensed data will be operate only by the Licensee’s employees and authorized contractors. A contractor shall be deemed authorized to use the licensed data only if the use of the licensed data is incidental to a larger relationship between the contractor and the Licensee.
2) LIABILITIES AND WARRANTIES: a) No Warranty of Use: i) Jackson County and its information suppliers make no representations or warranties of any kind with respect to services, information or data made available by Jackson County, including but not limited to the warranties of fitness for a particular purpose or merchantability or non-infringement; ii) The Licensor shall not be subject to liability for human errors, the use or appropriateness of use of the licensed data or the defect or failure of machines, or any material used in the connection with machines; iii) In no event shall Jackson County be liable, whether in contract, tort or otherwise, for any direct, indirect incidental or consequential damages, including lost savings or profit, attorney’s fees and cost, lost data or business interruption, even if Jackson County is notified in advance, related to the use of the licensed data. b) Data Accuracy - Jackson County does not warrant or make representations or endorsements as to the quality, content, accuracy, or completeness of the information, text, graphics, links, and other items contained on this server or any other server. Such materials have been compiled from a variety of sources, and are subject to change without notice from Jackson County as a result of updates and corrections: i) The information contained in the licensed data is from publicly available sources and is provided ‘as is’. <abstract>This theme delineates Urban Growth Boundaries (UGBs) in the state of Oregon. Oregon land use laws limit development outside of urban growth boundaries. The line work was created by various sources including the Oregon Department of Land Conservation and Development (DLCD), the Oregon Department of Transportation (ODOT), Metro Regional Council of Governments (Metro), county and city GIS departments, and the Oregon Department of Administrative Services - Geospatial Enterprise Office (DAS-GEO).</abstract>
<purpose>The theme was created to delineate UGBs and document amendments to these boundaries since their original designations. As of September 2008 DLCD has taken over maintaining the data so a process was established obtaining data on the UGB Coverage layer for the state. To obtain as much precise data as possible to digitize the boundary layer for accuracy statewide, every city/metro UGB was assessed and updated based on DLCD, county and city records.
Under the Oregon Geographic Information Council, the Framework Implementation Team has delegated the development of an Administrative Boundaries Implementation Plan and an Administrative Boundary Data Content Standard. The Administrative Boundaries Framework is a collection of prioritized, spatially referenced digital representation of broadly defined feature sets for Oregon; of which one was identified as UGBs with a Very High priority and DLCD tasked as being the steward of the data.
This feature set will be detailed in the Oregon Framework database posted on the website maintained by the Geospatial Enterprise Office and updated annually.</purpose>
<supplinf>Technical and Operation Context
The data environment is a vector model, comprised of area (polygons) and boundaries (lines) and spatial and maintenance relationships between areas. The exchange medium for administrative boundary data files is the ESRI shapefile, which is a public domain data structure relating feature geometry and feature attributes.</supplinf>

<datacred>This dataset was originally created in 2004 at the Oregon Department of Employment under a grant from the Oregon Geographic Information Council (OGIC). In 2006, DLCD partnered with the University of Oregon's Infographics Lab and ODOT for another comprehensive update to the data following as closely as possible the methodology followed in the 2004 project.
In 2008 DLCD took stewardship of the data and began a refined methodology necessary to bring the UGB data in line with other statewide framework elements through the OGIC data standards process. UGBs were optimized with reliance on cadastral tax lot data acquired through the Oregon Department of Revenue ORMAP project.
Every jurisdiction's entire UGB was reviewed against County records, City records and DLCD records. Discrepancies were verified against acknowledged plan amendments and/or City Ordinances.</datacred>

Attributes were checked against the Plan Amendment and Periodic Review database as well as with County and Cities where discrepancies appeared. Quality of the attribute information varies with age and mapping protocols used if no digital data were available.</attraccr>

<procdesc>One of the major tasks in initially creating the UGB layer was to create an effective process for identifying, determining and documenting data sources for the layer. This included examining numerous existing data sources prepared and compiled by local and state jurisdictional bodies. It is critical to effectively include all potential stakeholders into the framework process since it will improve the quality and resolution of the spatial data, increase the potential attributes associated with the GIS data, and provide potential methods for establishing longterm maintenance of the data. Emails were sent to all primary local jurisdictional authorities with maps of boundaries for review. Data requests were made directly to the GIS Coordinators or Senior Planning staff. Overall, local contacts had a high response rate. Data stewards contacted during this project are available at DLCD.</procdesc>

<procdesc>UGB lines were digitized using ArcView and ArcMap. Data sources were used to define line, reliability of the data source in feet, and the cadastral data used for verification were all entered into a GIS database. Amendments and original UGBs were identified as points with the related jurisdiction name and DCLD amendment number. Topology errors, dangle nodes and label errors were determined in ArcCatalog/ArcMap and were re-digitized to ensure all line networks were complete and each amendment and original UGB existed. Line work, in combination with point coverage, was used to create a comprehensive polygon coverage for all UGBs and their amendments.</procdesc>

<distliab>JACKSON COUNTY OFFICE OF GEOGRAPHIC INFORMATION SYSTEM LICENSE AGREEMENT THIS AGREEMENT is made by and between Jackson County called 'Licensor' and the client identified on the form, hereinafter called 'Licensee.' The Licensor is the authorized owner of multi-purpose GIS data and the repository of Jackson County specific data, the ownership of which is retained by its originating agency. The Licensor is authorized to disseminate GIS data and to charge fees for this service. The Licensee wishes to secure the non-exclusive right to use the Jackson County GIS (JCGIS) data IN CONSIDERATION of the mutual covenants and conditions herein contained, the Licensor and Licensee agree as follows: 1. RIGHTS GRANTEDIn consideration of the fees set forth on the reverse the Licensor grants to the Licensee the non-exclusive and non-transferable right to use the licensed products and data identified on the reverse (hereinafter the 'licensed data') until such time as this Agreement is terminated pursuant to Section 6 hereof or otherwise expires. 1.1 License of Data and Hardcopy Map Products - The licensed data shall normally be furnished on magnetic tapes, disk or as hardcopy map products; provided, however, that if any other means of communication, delivery or storage shall be used, the terms and provisions of this agreement shall nevertheless apply thereto. 1.2 Delivery - The Licensor shall deliver the licensed data shown on the form through means of tapes, disk, printed materials, manuals, or other means of communication to the Licensee. All such data, tapes, disks, manuals, and printed materials furnishedby the Licensor shall be and remain the property of Jackson County; and the Licensee shall at its own expense return all the data and all means of communication to the Licensor when and if directed upon termination. 1.3 Restrictions on use - The licensed data are solely and exclusively for the internal use of the Licensee and not for the use by any other person or entity, including, but not limited to, any entity which is affiliated with the Licensee unless specifically included in the term Licensee. 1.4 Permitted Use a. Copies. The Licensee may copy licensed data only for backup purposes and not for use by any other person. b. Equipment. Licensed data may be used only on computer equipment owned or leased by the Licensee. c. Derived Products. Graphic displays and printed tabular listings derived from licensed data may be used in publications and presentations, providedthat credit is given to JCGIS as the custodian of the data and credit is also given to the original source of the data if other than the Licensor. 1.5 Prohibited Use a. Unauthorized Distribution. Any sale, distribution, loan, or offering for use of licensed digital data, in whole or in part, is prohibited without the approval of the Licensor. b. Reproduction of Products. The reproduction of hardcopy products, as provided by the Licensor, with the intent to sell for a profit is prohibited without the written consent of the Licensor. 2. ROYALTIES AND PAYMENTS 2.1 Payment Upon Delivery - Payment of License fees, as shown on the Licensor's Request for Data form, must be made upon delivery of the product. 2.2 Payable to the Office of GIS - The license fee shall be paid by check in US currency, made payable to '_____' 3. ASSIGNMENT3.1 No Assignment - This Agreement may not be assigned by the Licensee without the expressed written consent of the Licensor, in advance; the permitted assignee thereof shall have all the rights and remedies of the original Licensee insofar as the same are assignable. Assignment shall be only as a whole and not as a part, nor as to any part interest therein. 4. INDEMNIFICATION 4.1 Indemnification - Licensee agrees to hold Jackson County and all its employees, and agents harmless from any claim, suit, or proceeding arising out of the use of the licensed data in accordance with this Agreement, including indemnification Jackson County for reasonable expenses incurred in defending such claims. 5. WARRANTIES AND LIABILITIES 5.1 Warranties and Liabilities Neither the Licensor nor the owner(s) of these data make any warranty,expressed or implied, as to the use or appropriateness of use of the licensed data, and there are no warranties of merchantability or fitness for a particular purpose or use. The information contained in the licensed data is from publicly available sources, but no representation is made as to the accuracy or completeness thereof. The Licensor shall not be subject to liability for human errors, defect or failure of machines, or any material used in the connection with the machines, including, but not limited to, tapes, disks, punch cards and energy. The Licensor shall not be liable for any lost profits or consequential damages, or claims against the Licensee by Third parties. The liability of the Licensor for damages, regardless of the form of the action, shall not exceed the License fee paid for the licensed data.</distliab>
