<useLimit>JACKSON COUNTY GEOGRAPHIC INFORMATION SYSTEM DATA LICENSE THIS AGREEMENT is made by and between Jackson County called 'Licensor' and the user, hereinafter called 'Licensee.' The Licensor is the owner of multi-purpose GIS data and Jackson County specific data and the authorized repository of other GIS data that is not owned by the Licensor. This Agreement shall not transfer the ownership of any GIS data, which shall be retained by its current owner. The Licensee wishes to secure the non-exclusive right to use the Jackson County GIS (JCGIS) data.
IN CONSIDERATION of the mutual covenants and conditions herein contained, the Licensor and Licensee agree as follows: 1) TERMS OF USE: a) Rights Granted: i) The Licensor grants to the Licensee the non-exclusive and non-transferable right to use the licensed products and data (hereinafter the 'licensed data'); ii) Licensee assumes responsibility to determine the appropriate use of the licensed data; iii) Data Delivery - The licensed data shall normally be furnished as a no-cost, online download delivered on the JCGIS website. If other means of delivery or storage shall be used, all such data, tapes, disks, manuals, and printed materials will be furnished by the Licensor for a fee. The terms and provisions of this agreement shall nevertheless apply thereto. b) Permissions: i) The licensed data are for use by the Licensee only, and are not intended to be republished or sold; ii) The Licensee may copy licensed data only for backup purposes and not for use by any other person; iii) Licensed data may be used only on computer equipment owned or leased by the Licensee; iv) Graphic displays and printed tabular listings derived from licensed data may be used in publications and presentations unless otherwise noted in Metadata. c) Limitations: i) The licensed data remains the sole intellectual property of its respective owner(s) and is used herein with permission; ii) Any available metadata (documentation file) is an integral part of the licensed data and shall be used with and accompany the licensed data. Users shall read it and abide by its terms and conditions; iii) Any sale, reproduction, distribution, loan, or offering for use of licensed data by the Licensee, in whole or in part, is prohibited. d) Authorized Users – The licensed data will be operate only by the Licensee’s employees and authorized contractors. A contractor shall be deemed authorized to use the licensed data only if the use of the licensed data is incidental to a larger relationship between the contractor and the Licensee.
2) LIABILITIES AND WARRANTIES: a) No Warranty of Use: i) Jackson County and its information suppliers make no representations or warranties of any kind with respect to services, information or data made available by Jackson County, including but not limited to the warranties of fitness for a particular purpose or merchantability or non-infringement; ii) The Licensor shall not be subject to liability for human errors, the use or appropriateness of use of the licensed data or the defect or failure of machines, or any material used in the connection with machines; iii) In no event shall Jackson County be liable, whether in contract, tort or otherwise, for any direct, indirect incidental or consequential damages, including lost savings or profit, attorney’s fees and cost, lost data or business interruption, even if Jackson County is notified in advance, related to the use of the licensed data. b) Data Accuracy - Jackson County does not warrant or make representations or endorsements as to the quality, content, accuracy, or completeness of the information, text, graphics, links, and other items contained on this server or any other server. Such materials have been compiled from a variety of sources, and are subject to change without notice from Jackson County as a result of updates and corrections: i) The information contained in the licensed data is from publicly available sources and is provided ‘as is’. No representation or endorsements of any kind are made as to the accuracy or completeness with respect to services, information, or data made available: (1) Data may be outdated, inaccurate, and may omit information; (2) JCGIS shall not be subject to liability for errors, omissions, or accuracy in the digital data, or underlying records and the utility of the data on any other system; (3) Correction of defects is not guaranteed; ii) The user is responsible for understanding the accuracy limitations of this data and acknowledges and accepts these limitations, including the fact that the data is dynamic and is in a constant state of maintenance, correction and update. c) Distribution - Distribution of this data is intended for informational purposes only and does not meet standards for navigational, engineering, surveying, or legal uses and definitions. 3) PAYMENTS: Payment of fees, if applicable, must be made prior to the delivery of the product. 4) ENDORSEMENTS: Some of the internet hyperlink contained in the licensed data lead to resources outside Jackson County's control. 5) INDEMNIFICATION: Licensee agrees to hold Jackson County and all its employees, and agents harmless from any claim, suit, or proceeding arising out of the use of the licensed data in accordance with this Agreement, including indemnification Jackson County for reasonable expenses incurred in defending such claims. 6) TERM: a) The term of this license shall be effective beginning the date signed by Jackson County and Licensee. b) This license shall expire three (3) years from the effective date, unless otherwise terminated pursuant to the terms of this license. c) Jackson County or Licensee may terminate this license, with or without cause, after 10 days written notice to the other party. d) Upon expiration or termination of this license, Licensee shall return all copies of the licensed data to Jackson County and remove any and all copies of the licensed data from the computers or other equipment owned or controlled by the Licensee.</useLimit>

Driveways and primary access routes were digitized for all building outlines in the current County GIS except those directly adjacent to and directly accessed from the nearest road centerline. Structures were considered to be "directly adjacent" to a road if they were within approximately 75 to 100 feet of the GIS road centerline. Features were digitized from aerial photography using stereo photogrammetric mapping technologies and were interpreted within the constraints of that technology and the visibility of features on the photography. No field verification or other research was conducted to verify location of driveways in obscured areas or that driveways shown are drivable or free of obstacles. Existing County aerial photography ranging in date from 2001 through 2003 was used. Photo scales ranged from 1"=1000' (immediate Medford vicinity) to 1"=2000' (remaining areas). In areas covered by multiple flight, the most current flight was used. Specific photo boundaries, flight dates and photo scale information for the photography used for this project can be found in the index shape file: Date_of_aerial_photo.shp Surface type was attributed as paved, unpaved or unsure of surface. A secondary attribute was added to the layer names to indicate if the feature was extracted from the old County centerlines file. The surface type for features in the County centerline file appears to have been verified and would have a higher degree of reliability than surface type interpreted from the aerial imagery. Driveway vector data represents the interpolated centerline between driveway edges or the centerline of a clearly defined route. Parking vector data represents only a generalized route intended to show primary access from County road centerlines.&lt;/SPAN&gt;&lt;/P&gt;&lt;/DIV&gt;&lt;/DIV&gt;&lt;/DIV&gt;</idAbs>

<stepDesc>** Driveway centerlines and access to structures were digitized using "heads up" digitizing on softcopy stereo photogrammetric workstations. Digital scans existed for the most recent county flights. Digital images were scanned from film for those flights which were previously mapped with diapositives. All control and aerotriangulation was directly imported from previous work. ** A "driveway" was considered to be any apparently driveable roadway (within the limits of interpretation from stereo aerial imagery) that provides access to a structure and is not already represented by a road centerline in the County's road centerline "streets.shp" database dated 11/9/05. ** Road centerlines and structures / site addresses to show access to were attained from County GIS source data files referenced by the source citation. ** Driveways and access routes were digitized for all structures and site addresses in the County source file if the following criteria were met: 1) Driveway / access up to the structure is more than 75' to 100' in length from the road centerline, 2) Primary access is not directly off of the nearest road centerline 3) Multiple driveways provide primary access from more than one road centerline ** Driveways were generally not digitized for structures within 75' 100' of the road, where access is directly off of a road centerline already in the County database. ** Driveways were not connected or included if there was an identifiable, permanent obstruction that would limit access. Minor obstructions, temporary obstructions and features such as locked gates would not have been identifiable on the photography and these routes would have been shown, even though access may in fact be blocked. Similarly, obstructions in areas obscured by heavy vegetation or shadow may not have been visible and would not be depicted in the driveways coverage. ** Interpretation of drivable routes and accesses was limited to visibility of features on the source photography. In areas obscured by vegetation or shadow, features represent a best reasonable interpretation from the aerial imagery and may not meet stated accuracies. If a feature needed to connect the coverage was completely obscured to the point that it could not be reasonably interpolated from the imagery, it was attributed as "OBSCURED." ** Features were attributed as DRIVEWAY_, ALLEY_ or PARKING_ ** An additional attribute of _COUNTY was added to indicate that surface type was extracted from the old County centerline coverage and may be more reliable than surface type determined solely from the aerial photography ** ALLEY_, DRIVEWAY_: Driveway and alley centerlines were interpolated between the edge of the roadway or drivable route as visible on the photography. ** PARKING_: A "parking" access line represents a generalized route for primary access from County road centerlines in the GIS source files. Parking access is general in nature and may not represent the centerline of any feature. Access routes were digitized as the center of a drivable path if there was an obvious defined route. Otherwise only a generalized route was shown. Multiple alternate paths / connections through the parking area and multiple adjacent entrances to the same parking lot were not digitized. ** All driveways / parking routes digitized were connected to a road centerline. ** If there was a gap in the County's road centerline database, a new road centerline was digitized and included in a separate coverage for incorporation into the County's database. ** If an existing road centerline was slightly off center as visible on the photography, the new driveways were tied into the existing location. In rare cases where the existing road centerline was more than a full road width off the true location as visible on the photography, a corrected road centerline was digitized. These road "fixes" were delivered as a separate coverage for incorporation into the County's database. ** All centerlines and parking area routes were snapped at end points and for exact snap to existing road centerlines. ** Batch processes were run at the final edit phase with a tolerance of 5' to eliminate any remaining undershoots or dangles. ** All features were broken to include nodes at the intersection with another driveway feature type or existing road centerline (the original, un-broken lines were retained by the aerial mapping contractor, but were not delivered).</stepDesc>
