<useLimit>JACKSON COUNTY GEOGRAPHIC INFORMATION SYSTEM DATA LICENSE THIS AGREEMENT is made by and between Jackson County called 'Licensor' and the user, hereinafter called 'Licensee.' The Licensor is the owner of multi-purpose GIS data and Jackson County specific data and the authorized repository of other GIS data that is not owned by the Licensor. This Agreement shall not transfer the ownership of any GIS data, which shall be retained by its current owner. The Licensee wishes to secure the non-exclusive right to use the Jackson County GIS (JCGIS) data.
IN CONSIDERATION of the mutual covenants and conditions herein contained, the Licensor and Licensee agree as follows: 1) TERMS OF USE: a) Rights Granted: i) The Licensor grants to the Licensee the non-exclusive and non-transferable right to use the licensed products and data (hereinafter the 'licensed data'); ii) Licensee assumes responsibility to determine the appropriate use of the licensed data; iii) Data Delivery - The licensed data shall normally be furnished as a no-cost, online download delivered on the JCGIS website. If other means of delivery or storage shall be used, all such data, tapes, disks, manuals, and printed materials will be furnished by the Licensor for a fee. The terms and provisions of this agreement shall nevertheless apply thereto. b) Permissions: i) The licensed data are for use by the Licensee only, and are not intended to be republished or sold; ii) The Licensee may copy licensed data only for backup purposes and not for use by any other person; iii) Licensed data may be used only on computer equipment owned or leased by the Licensee; iv) Graphic displays and printed tabular listings derived from licensed data may be used in publications and presentations unless otherwise noted in Metadata. c) Limitations: i) The licensed data remains the sole intellectual property of its respective owner(s) and is used herein with permission; ii) Any available metadata (documentation file) is an integral part of the licensed data and shall be used with and accompany the licensed data. Users shall read it and abide by its terms and conditions; iii) Any sale, reproduction, distribution, loan, or offering for use of licensed data by the Licensee, in whole or in part, is prohibited. d) Authorized Users – The licensed data will be operate only by the Licensee’s employees and authorized contractors. A contractor shall be deemed authorized to use the licensed data only if the use of the licensed data is incidental to a larger relationship between the contractor and the Licensee.
2) LIABILITIES AND WARRANTIES: a) No Warranty of Use: i) Jackson County and its information suppliers make no representations or warranties of any kind with respect to services, information or data made available by Jackson County, including but not limited to the warranties of fitness for a particular purpose or merchantability or non-infringement; ii) The Licensor shall not be subject to liability for human errors, the use or appropriateness of use of the licensed data or the defect or failure of machines, or any material used in the connection with machines; iii) In no event shall Jackson County be liable, whether in contract, tort or otherwise, for any direct, indirect incidental or consequential damages, including lost savings or profit, attorney’s fees and cost, lost data or business interruption, even if Jackson County is notified in advance, related to the use of the licensed data. b) Data Accuracy - Jackson County does not warrant or make representations or endorsements as to the quality, content, accuracy, or completeness of the information, text, graphics, links, and other items contained on this server or any other server. Such materials have been compiled from a variety of sources, and are subject to change without notice from Jackson County as a result of updates and corrections: i) The information contained in the licensed data is from publicly available sources and is provided ‘as is’. 5) INDEMNIFICATION: Licensee agrees to hold Jackson County and all its employees, and agents harmless from any claim, suit, or proceeding arising out of the use of the licensed data in accordance with this Agreement, including indemnification Jackson County for reasonable expenses incurred in defending such claims. 6) TERM: a) The term of this license shall be effective beginning the date signed by Jackson County and Licensee. b) This license shall expire three (3) years from the effective date, unless otherwise terminated pursuant to the terms of this license. c) Jackson County or Licensee may terminate this license, with or without cause, after 10 days written notice to the other party. d) Upon expiration or termination of this license, Licensee shall return all copies of the licensed data to Jackson County and remove any and all copies of the licensed data from the computers or other equipment owned or controlled by the Licensee.</useLimit>

<measDesc>When FEMA revises an FIS, adjacent studies are checked to ensure agreement between flood elevations at the boundaries. Likewise flood elevations at the confluence of streams studied independently are checked to ensure agreement at the confluence. The FIRM and the FIS are developed together and care is taken to ensure that the elevations and other features shown on the flood profiles in the FIS agree with the information shown on the FIRM. However, the elevations as shown on the FIRM are rounded whole-foot elevations. They must be shown so that a profile recreated from the elevations on the FIRM will match the FIS profiles within one half of one foot.</measDesc>

<measDesc>Data contained in the DFIRM Database files reflect the content of the source materials. Features may have been eliminated or generalized on the source graphic, due to scale and legibility constraints. With new mapping, FEMA plans to maintain full detail in the spatial data it produces. However, older information is often transferred from existing maps where some generalization has taken place. Flood risk data are developed for communities participating in the NFIP for use in insurance rating and for floodplain management. Flood hazard areas are determined using statistical analyses of records of river flow, storm tides, and rainfall; information obtained through consultation with the communities; floodplain topographic surveys; and hydrological and hydraulic analysis. Both detailed and approximate analyses are employed. Generally, detailed analyses are used to generate flood risk data only for developed or developing areas of communities. For areas where little or no development is expected to occur, FEMA uses approximate analyses to generate flood risk data. Typically, only drainage areas that are greater than one square mile are studied.</measDesc>

Attribute accuracy was tested by manual comparison of source graphics with hardcopy plots and a symbolized display on an interactive computer graphic system. Independent quality control testing of FEMA's DFIRM database was also performed. To obtain more detailed information in areas where Base Flood Elevations (BFEs) and/or floodways have been determined, users are encouraged to consult the Flood Profiles and Floodway Data and/or Summary of Stillwater Elevations tables contained within the FIS report that accompanies this DFIRM database. Users should be aware that BFEs shown in the S_BFE table represent rounded whole-foot elevations. These BFEs are intended for flood insurance rating purposes only and should not be used as the sole source of flood elevation information. Accordingly, flood elevation data presented in the FIS report must be used in conjunction with the FIRM for purposes of construction and/or floodplain management. The 1-percent-annual-chance water-surface elevations shown in the S_XS table match the regulatory elevations shown in the FIS report.</measDesc>
